Modi confirms player tested positive

Mumbai: The Indian Premier League (IPL) on Sunday confirmed the exclusive report by cricketnirvana.com that an unnamed player had tested positive after a random test.

"IPL is aware of an adverse analytical finding (AAF) from the recently concluded Indian Premier League,'' confirmed IPL chairman and commisioner Lalit Modi. 

The random tests during the tournament were conducted by IDTM, Sweden-based independent agency which organized the anti-doping testing in accordance with World Anti-Doping Agency (WADA) standards. 

On their part, the International Cricket Council (ICC) too confirmed what cricketnirvana.com reported that they indeed received a report from the WADA lab. 

"The ICC is aware of an adverse analytil finding (AAF) from the IPL. As with any AAF that arises during a testing programme organised by one of the ICC's Members, it is the responsibility of that Member, in this case the BCCI, to deal with the process in a timely and fair manner,'' said a statement from the ICC.

"ICC will be closely monitoring the situation to ensure the correct action is taken by the BCCI. The ICC retains a right of appeal if any penalty that may be imposed is inconsistent with the WADA Code,'' said the ICC statement.

The ICC statement further informed that an accredited laboratory that has tested the sample sends a report to the commissioning body (IPL) and copies in WADA and the International Federation, in this case the ICC.

The tests conducted during the IPL were then forwarded to a WADA-approved laboratory in Switzerland for testing. The lab that analysed the samples was "Laboratoire Suisse d'Analyse du Dopage - Institut universitaire de médecine légale" based in Switzerland which is a WADA certified lab. 

"The testing laboratory has come back to IPL informing us that one of the players has tested positive for a banned substance. IPL has put into motion the process for dealing with the matter as per the Indian Premier League anti-doping policy which is based on the International Cricket Council anti-doping policy code," added Modi 

The next step, according to Modi, is that as soon as IPL officially receives the result from the lab it will marry those results with the data collected by IDTM to identify the player and also to see if that particular player applied for and granted a Therapeutic Use Exemption (TUE) for that particular drug. 

"Should the player have a valid TUE there will be no case to answer and the name of the player will not be released. This will be done by the IPL medical committee,'' explained Modi.

If on the other hand the player has not applied for and was granted the valid TUE then the following procedure will be followed:

1. The medical committee consisting of the IDTM representative and BCCI's official doctor Dr Anant Joshi will confirm as per IPL anti-doping rules whether the results so far declared are correct and whether the process followed is as per the guidelines. A note in writing will be sent to the player and his home board and to the franchisee on the findings. 

2. The player concerned will be informed that:
a) The Specimen supplied by the player has revealed an Adverse Analytical Finding and ;
b) the above-mentioned Adverse Analytical Finding constitutes a violation of paragraph 3.1.1 and/or 3.1.2 of the Code (subject, if appropriate, to theanalysis of the B Sample);
c) The player will have the right to request that the B Sample (supplied by him at the same time as the A Sample which has revealed said Adverse Analytical Finding) shall be analysed.
d) if the player requests that said B Sample be analysed, he and his representative along with an IPL representative will have the right to attend the opening and analysis of it;

3. Once the results of the same are obtained it will be referred to the IPL Drugs Tribunal, which includes" Dr Ravi Bapat (ex Vice Chancellor of MUHS), Sunil Gavaskar, and leading lawyer Shirish Gupte. 

The Tribunal will in due course follow the procedure as laid down in the Anti-Doping policy.
